Terms and Conditions

1. Interpretation & Definitions
In these Terms, “Company”, “we”, “us”, or “our” refers to Elite Performance Tuning (EP Tuning). “Customer”, “you”, or “your” refers to anyone purchasing Goods or Services from us. “Goods” means any physical items we sell (e.g. performance parts, exhausts, clutches). “Services” means any tuning, remapping, diagnostics, installations, or other work provided by us. “Order” means a request by you to purchase Goods or Services. “Charges” means the price payable for Goods or Services plus VAT, delivery, labour, or other applicable costs.

2. Applicability
These Terms apply to all Orders placed via our website, in person, by phone, or email. They override any other terms unless agreed in writing. By placing an Order, you confirm that you have read, understood, and accepted these Terms.

3. Orders, Quotations & Acceptance
All quotations are subject to change until accepted in writing. We reserve the right to refuse or cancel any Order for any reason, including stock or pricing issues. Your Order becomes binding once accepted or when we start the work or dispatch the goods. You are responsible for ensuring all details and vehicle information you provide are correct.

4. Price, Payment & Invoicing
All prices are in GBP and include VAT where applicable. Additional costs (e.g. extra labour, shipping, import duties) may apply and will be confirmed before proceeding. Payment is required before dispatch for Goods and on completion (or as agreed) for Services. Late payments may incur interest under the Late Payment of Commercial Debts (Interest) Act 1998. All payments must be made in cleared funds, and you are responsible for any transfer fees.

5. Delivery, Installation & Risk
For Goods: Delivery times are estimates only. Standard delivery is 3–5 working days, depending on stock availability at the time of your order. However, if products are shipped from our overseas warehouse, delivery may take 7–10 working days. We will provide up-to-date tracking information on your order throughout the delivery process.
We are not liable for delays caused by third parties. Risk passes to you once goods are delivered or collected. Title remains with us until payment is received in full.

For Services: Risk in your vehicle remains yours except where loss or damage is caused by our negligence. You must ensure your vehicle is insured, roadworthy, and safe for work.

6. Warranty & Liability
Goods are covered by the manufacturer’s warranty only, unless otherwise stated. Services are provided with reasonable skill and care. We are not liable for loss of profit, downtime, indirect damage, or issues caused by misuse, neglect, third-party interference, or inaccurate information. Our total liability shall not exceed the amount you paid for the relevant Goods or Services. Nothing in these Terms limits our liability for death, personal injury, or fraud.

7. Customer Responsibilities
You confirm that you are the legal owner (or authorised user) of the vehicle. You must disclose any relevant information and ensure a safe working environment. We accept no responsibility for issues caused by customer-supplied parts or for the legality of vehicle modifications — this remains your responsibility. Any issues must be reported in writing within 7 days of collection or delivery.

8. Intellectual Property
All intellectual property rights (including tuning maps, software, designs, and logos) remain with EP Tuning or our licensors. You are granted a limited, non-transferable license to use software or maps solely for the vehicle and purpose supplied.

9. Website Use
Use of eptuning.net is subject to these Terms, our Privacy Policy, and Cookie Policy. We reserve the right to correct errors, update information, and cancel orders where appropriate. You must not use the site for illegal activity, introduce viruses, or copy content without permission.

10. Cancellation, Returns & Refunds
If you are a consumer, you have statutory cancellation rights under the Consumer Contracts Regulations 2013. If you cancel before dispatch, we will refund you minus any outbound shipping. Faulty goods will be repaired, replaced, or refunded. Non-faulty returns may be accepted at our discretion, provided goods are unused and in original packaging (a restocking fee may apply). Once Services have started, cancellations may not be possible, and you will be charged for parts and labour completed up to that point.

11. Force Majeure
We are not liable for delays or failures caused by circumstances beyond our control (e.g. weather, strikes, parts shortages, or shipping delays). In such cases, we may extend deadlines or cancel the order with an appropriate refund.

12. Data Protection
We process your personal data in accordance with our Privacy Policy. By using our site or placing an Order, you consent to us using your details for order processing, communication, and marketing (if opted in).

13. Disputes & Governing Law
These Terms are governed by the laws of England & Wales. Any disputes will be handled under the exclusive jurisdiction of English courts. Before legal action, both parties agree to attempt resolution through good-faith discussion or mediation.

14. General
If any part of these Terms is found invalid, the remainder remains enforceable. Any waiver or variation must be in writing and signed by a director. These Terms, together with our Privacy Policy and order confirmations, represent the entire agreement between you and Elite Performance Tuning.
